Case Study

We were contacted by a managing director who was in dispute with a majority shareholder in his company and several members of the board. Our client’s contract of employment had purportedly been terminated at a board meeting and there were issues in relation to various payments that our client had received from the company. We established that there had been a number of breaches of Companies Act requirements on the part of the company and no legal justification for the termination of employment. Despite strenuous efforts to resolve matters, no suitable offer of compensation was forthcoming from the company and accordingly a claim of constructive dismissal was issued on behalf of our client. We were able to negotiate a substantial settlement for our client in advance of the Tribunal hearing date and a settlement agreement was reached dealing with all aspects of the business relationship including employment, directorship and company shares.

Case Study

We were contacted by a legal secretary who had been made redundant on the basis that she was a part time worker and refused to agree to work full time. Her employer told her that her job could be saved but that she would have to agree to work full time. Our client was a single parent and had child care commitments and was upset and concerned about the way she had been treated. Her employer refused to take part in any settlement negotiations. However, we were able to recover compensation on her behalf at an Employment Tribunal.
